A crash upends everything in a few seconds. You are dealing with an injury, a wrecked vehicle, and lost time at work, and within a day or two an insurance adjuster calls sounding helpful. That call is not there to help you. It is there to close your claim for as little as possible before you know what your case is worth.

First, the mistakes that cost people the most
Talking to the other driver’s insurer before you understand your claim. A recorded statement is used to shift blame onto you. You are not required to give one.
Accepting the first offer. Early offers land before the full extent of an injury is known. Once you sign a release, the claim is closed for good.
Waiting too long. Colorado generally gives you three years from the crash date to file a motor vehicle injury or property damage lawsuit (C.R.S. § 13-80-101(1)(n)(I)). That is a longer window than the two-year limit on most other injury claims, but it is a hard deadline. Talking to an insurance adjuster does not pause it. Evidence disappears well before then: video gets overwritten, skid marks fade, witnesses forget.
If a government vehicle or public entity is involved, a much shorter notice deadline applies (often 182 days under the Colorado Governmental Immunity Act). Crashes involving a minor can run on a different clock. If either fits your situation, do not assume you have three years.
How Colorado law decides what you recover
Fault is comparative. Colorado uses modified comparative negligence. You can recover damages as long as you are less than 50 percent at fault, and your recovery is reduced by your share of the blame. Insurers know this rule, so they work to pin as much fault on you as possible. Countering that is much of the actual work of a claim.
Insurance minimums are low. Colorado requires only modest liability coverage, which often falls short of what a serious injury costs. When the at-fault driver is underinsured or has no insurance, your own uninsured/underinsured motorist coverage becomes the case. Many people never learn they have it.
Your damages are more than the ER bill. A real claim accounts for future medical care, lost earning capacity, and pain, not just the receipts already in hand.

Car accidents. Rear-end, intersection, and lane-change collisions make up most crashes. Fault often looks obvious and still gets disputed by the insurer.
Truck and commercial vehicle accidents. A collision with a semi or commercial vehicle is a different kind of case. Federal trucking regulations apply, multiple parties can share liability (driver, carrier, cargo loader), and the trucking company’s investigators are working the scene fast. The stakes and the settlements are higher, and so is the resistance.
Motorcycle accidents. Riders face a built-in bias that they were reckless. That assumption shapes how insurers and juries assign fault, and it has to be dismantled with evidence.
Pedestrian accidents. A person on foot has no protection in a collision, so injuries are severe. Fault questions turn on crosswalks, signals, and right-of-way.
Wrongful death, When a crash takes a life, Colorado law lets surviving family pursue a claim. A strict two-year deadline applies (C.R.S. § 13-21-204), shorter than the standard motor vehicle injury window.
